Abstract
An analysis was conducted of the current jurisprudence from administrative courts on the issues involved in the delimitation of real estate with surface water. Cases were analyzed from the ruling Regional Administrative Courts and the Supreme Administrative Court. Particular emphasis was placed on administration cases to determine a shoreline, as well as the various activities undertaken which required a knowledge of geodesy, hydrology and law. The judicial interretations are presented with the supporting arguments of the proposed solutions and the critical evaluations done applying the principal of de lege ferenda.
